RE: The tariff classification of a girl’s blouse from India.

Dear Mr. Ryu:

In your letter dated February 1, 2008 you requested a classification ruling. The submitted sample is being retained for reference purposes.

Style 8324-2001 is described as “girls 100% cotton knit top.” The garment creates the visual impression of a woven short sleeve white shirt existing underneath a finely knit vee neck orange pullover. The pullover fabric is knit cotton. The short sleeve hem, exposed upper shirt placket, collar and lower body hem extensions are woven cotton. The placket has a two button closure that fastens right over left. The knit pullover section has shirred fabric below the bodice and puff sleeves. The knit pullover fabric imparts the essential character in accordance with General Rules of Interpretation 3 (b).

The applicable subheading for the blouse will be 6106.10.0030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ blouses and shirts, knitted or crocheted, of cotton, girls’, other. The duty rate will be 19.7 percent ad valorem.
