RE: The tariff classification of a man’s jacket from Thailand

Dear Mr. Powers:

In your letter dated January 30, 2008, you requested a classification ruling.

The sample submitted, style 319266 “FA08 Nike Sphere Pro Full Zip Jacket,” is a man’s hip-length jacket with a shell composed of a bonded fabric consisting of flat knit 100% polyester interlock fabric on the outer surface, a warp knit 100% polyester mesh fabric on the inner surface, and a layer of polyurethane in between. The polyurethane coating is visible through the mesh fabric.

The jacket has a stand-up collar, a full front opening secured by a zipper closure that extends to the top of the collar, a reflective strip of fabric on each side of the front zipper opening, long hemmed sleeves, two front pockets with zipper closures at the waist and a drawcord tightening with plastic cord stoppers through the bottom hem. The “Nike” logo is featured on the rear yoke.

The sample is being returned to you as you have requested.

The applicable subheading for the jacket will be 6113.00.9025, Harmonized Tariff Schedule of the United States (HTSUS), which provides for garments, made up of knitted or crocheted fabrics of heading 5903, 5906, or 5907: other: coats and jackets: men’s or boys’. The duty rate will be 7.1 percent ad valorem.

The jacket falls within textile category 634. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
