RE: The tariff classification of a duffle bag from China

Dear Mr. Yan:

In your letter dated January 24, 2008 on behalf of Bueno of California, Inc., you requested a tariff classification ruling. The sample which you submitted is being retained by this office.

The sample is identified as style CP9035. The item is a duffle bag with wheels designed to provide storage, protection and portability for clothing and other personal effects during travel. It is manufactured with an exterior surface of polyvinyl chloride (PVC) plastic sheeting. The interior of the bag has a main textile-lined compartment with pockets and a detachable PVC bag. The exterior of the bag has a zippered pocket on the front and drawstring pockets on the sides. The bag can be carried by means of double carrying handles or pulled by the retractable handle. It measures approximately 15” (W) x 5.5” (D) x 12” (H).

In your letter, you propose classification of the bag under subheading 8716.80.5020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for trailers and semi-trailers; other vehicles, not mechanically propelled; and parts thereof, other vehicles, other, other, portable luggage carts. The item is a travel bag, a named article of heading 4202, HTSUS. Thus it is more specifically provided for within heading 4202, HTSUS.

The applicable subheading for the duffle bag will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sport, and similar bags, with outer surface of plastic sheeting material, other. The rate of duty will be 20 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
