RE: The tariff classification of men’s woven pants from China

Dear Mr. Williams:

In your letter dated January 25, 2008, you requested a tariff classification ruling on behalf of Kindnoon Offshore Trading Co., Ltd. As requested, your sample will be returned.

The submitted sample, which you identify as “K&H X-System Pants” are a pair of men’s pants constructed from 100% nylon woven ripstop fabric in a printed camouflage design. The pants have a partially elasticized waistband with five belt loops, a metal button on the waistband, a zippered fly, quarter pockets on each side, a small pocket within the right quarter pocket, two back patch pockets with flaps and magnetic closures, cargo pockets on each leg with flaps and magnetic closures, two elastic strips sewn to each cargo pocket, overlaid fabric at each knee, and hemmed leg openings with drawstring closures.

The applicable subheading for the pants will be 6203.43.4010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for men’s or boys’ trousers, : of synthetic fibers: other: other: other: other: trousers: men’s. The rate of duty is 27.9 % ad valorem.

The pants fall within textile category designation 647. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
