RE: The tariff classification of a woman’s jacket from Hong Kong

Dear Ms. Iacobello:

In your letter dated January 14, 2008, you requested a classification ruling.

The sample submitted, CK style number LW1825, is a woman’s hip-length jacket with a shell composed of a woven 85% polyester/15% nylon fabric. The jacket is lined with a woven man-made fiber fabric. In a phone conversation you indicated that the jacket is not coated for water resistance.

The jacket has a cowl neck collar that is elasticized at the top, a full front opening secured by a zipper closure that extends to the top of the collar, ¾-length sleeves with elasticized cuffs, two front pockets at the waist and an elasticized waistband with a drawstring tightening.

The sample is being returned to you as you have requested.

The applicable subheading for the jacket will be 6202.93.5011, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other women’s anoraks, windbreakers and similar articles: of man-made fibers: other: other: other. The duty rate will be 27.7 percent ad valorem.

The jacket falls within textile category 635. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
