RE: The tariff classification of a digital camera back from Denmark.

Dear Mr. Sandager:

In your letter dated January 16, 2008, you requested a tariff classification ruling.

The merchandise in question is a digital camera back, which is a part of a medium-format digital camera. This digital back is the capture unit that can convert the optically formed image on a charged-coupled device (CCD) to an electronic file, which is stored on the internal compact flash card. These digital camera backs can record still pictures and can capture images of moving subjects. The body of the digital camera back is made of high-quality aluminum, which is designed to be mounted directly onto a digital camera housing. In addition, this camera back contains a 2.2 inch LCD display, a firewire port for communication purposes, and a flash memory interface card.

Your letter suggested classifying this merchandise under subheading 8525.80, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Television cameras, digital cameras and video camera recorders.” However, this office does not consider this digital camera back to be an incomplete or unfinished digital camera; therefore, classification under subheading 8525.80, HTSUS is not applicable.

The applicable subheading for this merchandise will be 8529.90.8600, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Parts suitable for use solely or principally with the apparatus of headings 8525 to 8528: Other: Other parts of articles of headings 8525 and 8527: Other. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
