RE: The tariff classification of a Christmas Tree Table Decoration (item# A072AA04543) from China

Dear Mr. Crago:

In your letter dated January 15, 2008, you requested a tariff classification ruling.

The Christmas Tree Table Decoration (item# A072AA04543) measures approximately 9.75” in height x 3.75” in diameter. The item is comprised of iron and iron wire, and is imported in the color gold. The Christmas Tree Table Decoration features wire wound around an iron rod that simulates a Christmas Tree decorated with a gold iron star tree topper.

The Christmas Tree Table Decoration (item# A072AA04543), topped with the gold iron star, simulates a recognized Christmas tree. Therefore, the item will only be used to decorate the home during the Christmas holiday.

The applicable subheading for a Christmas Tree Table Decoration (item# A072AA04543) will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Christmas ornaments: Other: Other.” The rate of duty will be Free.
