RE: The tariff classification of a decorative braid, from China.

Dear Mr. Crago:

In your letter dated January 10, 2008, which was a follow-up to an earlier inquiry where we requested additional information, you requested a tariff classification ruling. Your sample is being retained for our files.

The instant sample, identified as item #A072YA00351, consists of a spool of decorative braided cord having the traditional plaited construction. You state that the material consists of a 60% polyester (PET)/40% bulk continuous filament (BCF) construction. Specifically, the bulked continuous filaments constitute the core of the braid while the outer sheathing is composed of polyester plastic strips measuring less than 5 mm in apparent width. These strips are considered to be of man-made textile material for tariff purposes. The strips are dyed different colors and, in additional to being decorative in nature, impart the essential character to the item. Each spool contains braid in three different colors and they run 24-feet in length. They appear to be of a type that will be used to tie packages in a decorative manner.

The applicable subheading for the product will be 5808.10.9000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for braids in the piece, , other, other. The rate of duty will be 4.2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
