RE: The tariff classification of a Catcher Protector from China

Dear Mr. Boyd:

In your letter dated December 27, 2007, you requested a tariff classification ruling.

You are requesting the tariff classification on a product that is described as a Catcher Protector; there is no designated item number for the article. The instant merchandise is a molded plastic sports seat that will be marketed as a baseball training aid. The Catcher Protector incorporates a shield that protects the groin area from wild pitches. It will be used by both coaches and fathers for protection when catching baseballs during practice pitching sessions. The shield functions as a seat when placed into any 5 gallon bucket. It will be classified in Chapter 95 as other baseball articles.

The applicable subheading for the Catcher Protector will be 9506.99.1500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for baseball articles and equipment, except balls, and parts and accessories thereof. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
