RE: The tariff classification of Service Aggregation Switches (SAS) from China

Dear Mr. Linardakis:

In your letter dated December 30, 2007 you requested a tariff classification ruling, on behalf of your client World Wide Packets, Inc.

The merchandise subject to this ruling is Service Aggregation Switches (SAS). They are identified in your letter as Model Numbers 3300-CHADC1, 3300-CHAACI, 3300-CNTRL1, 3000-2P10L1, 3000-24PLM1, and 3000-24PLM2. They are Ethernet switches that support Carrier Ethernet services such as ELINE, EVPL, ELAN, and TLS. Their primary purpose is to help carriers deliver highly scalable and resilient Ethernet services for both business and residential customers. They are optimized for use in metro edge applications, including Voice over IP and IPTV services, enabling high-density Gigabit Ethernet connectivity services and high performance 10 Gigabit Ethernet connectivity services for a wide variety of Telecommunication and Data communication Service Providers Networks.

The applicable subheading for the Service Aggregation Switches (SAS), Model Numbers 3300-CHADC1, 3300-CHAACI, 3300-CNTRL1, 3000-2P10L1, 3000-24PLM1, and 3000-24PLM2, will be 8517.62.0050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other apparatus for transmission or reception of voice, images or other data, including apparatus for communication in a wired or wireless network (such as a local or wide area network): Machines for the reception, conversion and transmission or regeneration of voice, images or other data, including switching and routing apparatus: Other." The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
