RE: The tariff classification of a woman’s sleeveless pullover from China.

Dear Ms. Pudjijanto:

In your letter dated January 9, 2008 you requested a classification ruling. As requested, your sample is being returned to you.

The submitted sample, style 563336, is a woman’s “Old Navy” brand sleeveless pullover constructed from 100% cotton fabric. The garment is a 2x2 rib knit with the exception of the bust area which has a jersey knit. The outer surface of the garment measures more than nine stitches per two centimeters in the direction in which the stitches were formed. The garment features a tight-fitting body and a scoop front neckline with shaping darts at the bust area. You asserted classification as a tank top under 6109.10.0060, HTSUS, or as a garment similar to a tank top under 6109.10.0070, HTSUS. However, the shaping darts on the front panel precludes classification as either. As you alternately suggested, style 563336 is properly classified as a sleeveless pullover under 6110.20.2079, HTSUS.

The applicable subheading for the pullover will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: women’s or girls’: other. The duty rate will be 16.5%.

The pullover falls within textile category 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
