RE: The tariff classification of a ring from China.

Dear Mr. Ekstrand:

In your letter dated January 10, 2008, on behalf of U.S. Toy Company, Inc., you requested a tariff classification ruling. The sample which you submitted is being retained by this office.

Item number HL206 is a plastic battery-operated ring. The ring is shaped like a spaceship and is equipped with fiber optic strands attached to one end. There is an on/off switch that activates the optic strands to light up. The essential character of the ring is plastic based on the component breakdown you have provided.

The applicable subheading for the ring will be 7117.90.7500 Tariff Schedule of the United States (HTSUS), which provides for “Imitation jewelry: Other: Other: Valued over 20 cents per dozen pieces or parts: Other: Of plastics.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
