RE: The tariff classification of steel clamps, fabric comb and rolling laundry bag holder.

Dear Mr. Blight:

In your letter dated January 15, 2008 you requested a tariff classification ruling. The samples which you submitted are being retained by this office.

The five steel clamps that you plan to import are made of low carbon steel. They are used to connect round tubular pipes in the construction of a rack system. Mounted from the ceiling, this system is used in the dry cleaning industry to hold garments either waiting to be cleaned or for pick-up. The flange clamp is identified as RP10 and the 4-way clamp as RP40. The 3-way clamps are identified as RP30, RP 31 and RP33. Also under consideration is a fabric comb, identified as item BH12. This comb is designed to remove fabric pills from a garment. It has a wooden handle and the blade is made from low carbon steel that has been zinc plated. The final item is a rolling laundry bag holder. The frame and base of the holder are made of low carbon steel that has been zinc plated and the wheels are made of plastic. It is designed to hold a laundry bag that measures 30” by 40” or 30” by 45”.

The applicable subheading for all the clamps will be 7308.90.9590, Harmonized Tariff Schedule of the United States (HTSUS), which provides for structures (excluding prefabricated buildings of heading 9406) and parts of structures (for example, bridges and bridge sections, lock gates, towers, lattice masts, roofs, roofing frameworks, doors and windows and their frames and thresholds for doors, shutters, balustrades, pillars and columns) of iron or steel; plates, rods, angles, shapes, sections, tubes and the like, prepared for use in structures, of iron or steel, other, other, other, other, other. The rate of duty will be free.

The applicable subheading for the fabric comb will be 8205.59.5560, Harmonized Tariff Schedule of the United States (HTSUS), which provides for handtools (including glass cutters) not elsewhere specified or included; blow torches and similar self-contained torches; vises, clamps and the like, other than accessories for and parts of machine tools; anvils; portable forges; hand- or pedal-operated grinding wheels with frameworks; base metal parts thereof: other handtools (including glass cutters) and parts thereof: other: other: other: of iron or steel: other: other (including parts). The rate of duty will be 5.3 percent.

The applicable subheading for the rolling laundry bag holder will be 9403.90.8040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other furniture and parts thereof, parts, other, other, of metal. The rate of duty will be free.
