RE: The tariff classification of a women’s jacket from China

Dear Ms. Caldwell:

In your letter dated January 10, 2008, you requested a classification ruling. A sample was submitted and is being returned as you requested.

The item in question, style 110807-003, is a hip-length jacket with a shell made from a 100% polyester woven fabric joined to a nonwoven batting with elaborate needlework. The jacket has a full front opening with a zipper closure that extends to the top of the collar, a rib knit waistband, cuffs and collar, slant pockets at the waist, a gusset in the center back and a woven polyester lining.

The applicable subheading for style 110807-003will be 6202.93.5011, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other women’s anoraks (including ski-jackets), windbreakers and similar articles of man-made fibers. The duty rate will be 27.7 percent ad valorem.

This jacket falls within textile category 635. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
