RE: The tariff classification of plastic bread boxes from Italy

Dear Ms. Davidson:

In your letter dated January 9, 2008 you requested a tariff classification ruling.

The submitted illustration depicts items identified as Roll-Top Bread Boxes, SKU# 10015551. These items are made of a clear polycarbonate plastic material that is virtually unbreakable. They are used to preserve the freshness of baked goods, such as breads, bagels, or pastries, while providing clear visibility of these goods. These boxes have smooth roll-top doors that glide up and down for easy access to the baked goods that are stored inside. The small size is specifically designed for kitchenettes and galley-style kitchens.

The applicable subheading for SKU# 10015551 will be 3924.10.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for tableware, kitchenwareof plastics: tableware and kitchenware: other. The rate of duty will be 3.4 percent ad valorem.
