RE: The tariff classification of a hydraulic cylinder from China

Dear Mr. Patterson:

In your letter dated January 8, 2008 you requested a tariff classification ruling. A technical drawing was submitted.

The article in question is described as a hydraulic cylinder used to operate food processing equipment. The submitted drawing reveals that the cylinder is a linear hydraulic cylinder that is constructed using tie-rods.

The applicable subheading for the subject cylinder will be 8412.21.0015, Harmonized Tariff Schedule of the United States (HTSUS), which provides for hydraulic power engines and motors, linear acting (cylinders), tie-rod type. The rate of duty is free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
