RE: The tariff classification of a passport holder from China

Dear Ms. Ramsey:

In your letter dated January 3, 2008, you requested a tariff classification ruling. The sample which you submitted is being retained by this office.

The item submitted is identified as style number 63640. It is a bi-fold passport holder constructed with an outer surface of polyurethane (PU) sheeting material. It is designed to provide storage, protection, portability, and organization for a passport, identification, and other travel documents. The interior features two credit card slots, and two additional pockets. It measures approximately 4” (W) x 5.5” (H) in its folded condition.

The applicable subheading for the passport holder will be 4202.92.9060, Harmonized Tariff Schedule of the United States (HTSUS), which provides in part, for other bags and containers, with outer surface of sheeting of plastic, other, other, other. The rate of duty will be 17.6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
