RE: The tariff classification of the “Christmas Tree Light On/Off Push Switch” (Item #A014GA00888) from China

Dear Mr. Crago:

In your letter dated January 7, 2008 you requested a tariff classification ruling.

The merchandise under consideration is the “Christmas Tree Light On/Off Push Switch”, (Item #A014GA00888). This item consists of a ten foot long electrical extension cord which incorporates a combination electrical plug/outlet connector on one end and a star shaped plastic push-button switch on the opposite end.

This item is used to easily turn Christmas lights on and off. The switch is designed in the shape of a star and is intended to be placed directly on a Christmas tree as an ornament. The combination plug/outlet connector gets plugged into to a household outlet, and then a string of Christmas lights can be plugged directly into the combination plug/outlet connector. By pressing the star shaped switch you are able to conveniently turn the Christmas lights on and off. This device is rated for 600 Watts at 120 Volts and 5 Amps. It is designed for indoor use only and is UL and CL listed.

The applicable subheading for the “Christmas Tree Light On/Off Push Switch” will be 8544.42.9000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Insulated wire, cable: Other electric conductors, for a voltage not exceeding 1,000V: Fitted with connectors: Other: Other”. The rate of duty will be 2.6%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
