RE: The tariff classification of woman’s pullover from Thailand.

Dear Ms. Holler:

In your letter dated December 18, 2007 you requested a classification ruling. As requested, your sample will be returned to you.

The submitted sample, style 0853, is a woman’s cut and sewn pullover that is constructed of a 100% polyester double-knit mesh fabric. The outer surface of the garment measures more than nine stitches per two centimeters in the direction in which the stitches were formed. The garment sample features a crew neckline, short sleeves with rib knit cuffs, and a straight hemmed bottom. You have indicated that the garment will have a large screen print on the front panel.

The applicable subheading for the pullover will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: women’s or girls’: other. The duty rate will be 32%.

The pullover falls within textile category 639. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
