RE: The tariff classification of a men’s knit pullover garment from Pakistan.

Dear Ms. Huang and Ms. Cheung:

In your letter dated December 27, 2007, you requested a tariff classification ruling. As requested, your sample will be returned.

The submitted sample, Reference Number BR122707, is a men’s layered look pullover that is designed to resemble a short sleeve T-shirt worn over a long sleeve pullover garment. The garment features a rib knit crew neckline; short, hemmed sleeves over long, hemmed sleeves; and a straight, hemmed bottom. The front and back panels and the short sleeves are constructed from 60% cotton, 40% polyester, jersey knit fabric that measures 28 stitches per two centimeters counted in the horizontal direction. The long sleeves are constructed from 60% cotton, 40% polyester, waffle knit fabric.

The applicable subheading for Reference Number BR122707 will be 6110.20.2069, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: men's or boys': other. The duty rate is 16.5% ad valorem.

Reference Number BR122707 falls within textile category designation 338.
