RE: The tariff classification of a part of a housing assembly for an automotive Hydraulic Control Unit from Mexico

Dear Ms. Wallett:

In your letter dated December 26, 2007 you requested a tariff classification ruling. Descriptive literature and a sample were submitted.

The article you plan to import is described as a plastic housing used in automotive Electronic Braking Systems (EBS) assemblies. You indicate that a hydraulic valve, analog controllable cut-off valves and integrated pressure sensors will be mounted to this plastic housing to complete the assembly. EBS use hydraulic pressure in place of the air signal sent by the brake pedal to activate the brakes, improving stopping distances and braking system performance.

You suggest classification of the plastic housing under subheading 8536.90.8085, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for “Electrical apparatus for switching or protecting electrical circuits, or for making connections to or in electrical circuitsfor a voltage not exceeding 1,000 V: Other apparatus: Other: Other." However, since the plastic housing serves as a manifold for the valves, we find the plastic housing is more specifically provided for as a part of a hydraulic valve in subheading 8481.20 HTSUS.

The applicable subheading for the plastic housing will be 8481.90.9040, HTSUS, which provides for other parts of taps, cocks, valves and similar appliances of subheading 8481.20. The rate of duty is free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
