RE: The tariff classification of a woman’s blouse from China

Dear Ms. Root:

In your letter dated December 14, 2007, you requested a classification ruling on behalf of Sugartown Worldwide, Inc. Your sample will be returned as requested.

Submitted sample, style #68212, is a woman’s blouse constructed from 55% linen and 45% cotton woven fabric. The pullover blouse is collarless and features a round neckline, long sleeves, three inch side vents, a hemmed bottom and decorative embroidery.

The applicable subheading for the style 68212 will be 6206.90.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of other textile materials: other. The duty rate will be 6.7 percent ad valorem.

Style 68212 falls within textile category 840. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
