RE: The tariff classification of scrub shirt from China.

Dear Mr. Wood:

In your letter dated December 11, 2007, you requested a classification ruling. The sample which you submitted is being returned as requested.

The submitted sample Style FD8011is a lady’s scrub shirt made of woven 60% cotton/40% polyester fabric. The scrub shirt is hip length with short sleeves a V neckline and pockets below the waist.

      The applicable subheading for Style FD8011 will be 6211.42.0056, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: Of cotton: Blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments, excluded from heading 6206: Other.” The duty rate will be 8.1 percent ad valorem. The textile category designation is 341.
