RE: The tariff classification of infant’s items from China.

Dear Ms. Irish:

In your letter dated December 17, 2007 you requested a classification ruling. The sample will be returned to you as requested.

The submitted sample, style 84689001, is described as a “newborn layette 3 piece set.” The set includes a long sleeve onesie with woven Peter Pan collar, three snap back opening and three snap crotch opening; a pair of footed pull-on pants with covered elasticized waistband and a sock hat with rolled brim. The items are constructed from the same finely knit interlock cotton fabric. The set is sized for babies 3 to 6 months of age.

The layette set will be imported in a “keepsake box” with a tie closure. The box is made of cardboard. The “keepsake box” is considered normal packaging for the apparel. The cardboard container is not classified separately because it is not clearly suitable for repetitive use.

The applicable subheading for style 84689001 will be 6111.20.6020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for babies’ garments and clothing accessories, knitted or crocheted: of cotton: other: other, sets. The duty rate will be 8.1 percent ad valorem.

Babies’ cotton sets fall within textile category 239. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
