RE: The tariff classification of a woman’s blouse from China

Dear Mr. Victoria:

In your letter dated December 14, 2007, you requested a classification ruling. The submitted sample will be returned as requested.

Style 82438D is a woman’s blouse composed of knit and woven components. The front and back panels are constructed from 75 percent silk, 20 percent nylon and 5 percent spandex knit fabric. The sleeves, collar and front insert are constructed from 65 percent polyester and 35 percent cotton woven fabric. The garment features long sleeves with button cuffs, a collar and a partial front opening secured by six buttons.

Neither the knit nor the woven component provides the essential character of the garment. Therefore, in accordance with General Rules of Interpretation, GRI 3©, the garment shall be classified under the heading which occurs last in numerical order among those which equally merit consideration. In this case, the heading is 6206, HTS.

The applicable subheading for style 82438D will be 6206.40.3030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of man-made fibers: other: other: other: women’s. The duty rate will be 26.9 percent ad valorem.

Style 82438D falls within textile category 641. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
