RE: The tariff classification of Halloween Witch Gloves (item number A079CA00162) from China

Dear Mr. Crago:

In your letter dated December 11, 2007, you requested a tariff classification ruling on Halloween Witch Gloves (item number A079CA00162) which are being returned upon your request.

The Halloween Witch Gloves are comprised of 100% nylon and measure approximately 18” in length. The item consists of a pair of black fingerless gloves that features a spider web design.

Although referred to as “gloves”, the Halloween Witch Gloves are not functional, as they have no fingers, palms or support. Instead of functioning gloves, the item is a textile decorative slip-on for use as a costume accessory.

The applicable subheading for Halloween Witch Gloves (item number A079CA00162) will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
