RE: The tariff classification of unisex Chef Coats from China.

Dear Mr. Park:

In your letter dated December 7, 2007, on behalf of Wisechoice Int’l (USA) Inc., you requested a classification ruling.

Style 35000-092/60 is a Chef Coat made of woven 65% polyester/35% cotton fabric. The garment extends to approximately just below the hip and has a mandarin collar, long sleeves, left breast pocket and a full length double breasted closure that closes left over right or right over left.

Style 100424-092/3X Large is a Chef Coat made of woven 65% polyester/35% cotton fabric. The garment extends to approximately just below the hip and has a mandarin collar, 3/4 sleeves, left breast pocket and a full length double breasted closure that closes left over right or right over left.

           The applicable subheading for the Styles 35000-092/60 and 100424-092/3X Large will be 6206.40.3030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Women’s or girls’ blouses, shirts and shirt-blouses: Of man-made fibers: Other: Other, Other: Women’s." The duty rate will be 26.9% ad valorem. The textile category designation is 641.
