RE: The tariff classification of motor vehicle parts from Germany

Dear Mr. Resetar,

In your letter dated December 11, 2007, you requested a tariff classification ruling.

The items under consideration are window panels which are to be mounted on the sides and rear of racing vehicles. Photographs of the two installed window panels were included in your Ruling Request.

Both the side and rear window panels are constructed of formed, clear polycarbonate. The side panels are mounted to the vehicle’s door panel. Because, as you state in your request, they will be used exclusively with racing vehicles, the window panels do not retract into the doors or open in any way.

The applicable classification subheading for the side and rear window panels will be 8708.29.5060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Partsofmotor vehicles : Other partsof bodies: Other: Other: Other”. The rate of duty will be 2.5%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
