RE: The tariff classification of a woman’s top from Brazil

Dear Ms. Stanczak:

In your letter dated December 3, 2007 you requested a classification ruling.

Style ELTK302 is a woman’s top constructed from 74 percent acrylic, 24 percent polyamide and 2 percent spandex knit fabric. The garment extends below the waist and features long sleeves with rolled cuffs and a rolled bottom. The back of the garment has a deep v neckline extending to the waist, exposing most of the back and three narrow self fabric straps attached to each side of the v neckline. The front of the garment consists of two panels one which crosses over the other panel forming a v neckline.

The applicable subheading for style ELTK302 will be 6114.30.1020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for topsknitted or crocheted: Of man-made fibers: women’s. The duty rate will be 28.2% ad valorem.

Style ELTK302 falls within textile category 639. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise, which is the product of World Trade Organization (WTO) member countries.
