RE: The tariff classification of adult costumes from China.

Dear Fragomeli:

In your letter dated December 5, 2007, you requested a classification ruling. The samples which you submitted are being returned as requested.

The UNDEAD STALKER Costume Set will be imported as follows:

Items 6808823 Size S, 6808824 Size M and 6808825 Size L – Adult Men

The UNDEAD STALKER Costume Set consists of a unisex coat-style garment and hat made of knit velour 100% polyester fabric. The full-length coat-style garment has long sleeves, stand-up collar and straps with hook and loop closures at the front. The coat does not protect from the elements.

The costume is well-made with a sturdy collar, closures edges and styling.

General Rule of Interpretation (GRI) 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” In this case, the coat imparts the essential character of the set.

The applicable subheading for the UNDEAD STALKER Costume Set, Items 6808823, 6808824 and 6808825 will be 6114.30.3070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other garments, knitted or crocheted: Of man-made fibers: Other, Other: Women’s or girls’." The rate of duty will be 14.9% ad valorem. The textile category designation is 659.
