RE: The tariff classification of a coin purse from China

Dear Ms. Kelly-Kobayashi:

In your letter dated November 28, 2007, on behalf of Deckers Outdoor Corporation, you requested a classification ruling. The sample which you submitted is being returned as requested.

The item which you referred to as a “Green Toe Pouch” is a coin purse constructed with an outer surface of 100% jute textile material. The purse features a single lined compartment to hold credit cards, coins, and paper currency. It has a top opening that is secured by a hook-and-loop fastener. It measures approximately 3.5” (W) x 4.5” (L).

The applicable subheading for the purse will be 4202.32.8000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for articles of a kind normally carried in the pocket or in the handbag, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction, other. The rate of duty will be 5.7 percent ad valorem.

HTSUS 4202.32.8000 falls within textile category 871. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
