RE: The tariff classification of hosiery from China.

Dear Ms. Tovar:

In your letter dated November 27, 2007, written on behalf of your client, SourceLink LLC, you requested a classification ruling.

You have submitted a sample of what you refer to as a “Foot-Opia Foot Veil,” made of 80% nylon, 15% polyester, and 5% spandex knit fabric. The article is worn on the foot and resembles a sock which extends to slightly above the ankle, with openings for each toe as well as an opening for the heel of the foot. You state that it will be sold via website either in pairs or as a single unit for one foot only. The “Foot-Opia Foot Veil” will be marketed as a sexual novelty item.

The applicable subheading for the “Foot-Opia Foot Veil” will be 6115.96.9020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for panty hose, tights, stockings, socks and other hosiery, other: of synthetic fibers: other: other, other. The duty rate will be 14.6% ad valorem.

The article falls within textile category 632. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
