RE: The tariff classification of a kitchen towel from China

Dear Ms. Kay:

In your letter dated November 21, 2007 you requested a classification ruling.

The submitted sample is a 3-pack kitchen towel referred to as “Solid Pique Front Loop Terry Back”. The towels are made from 100 percent cotton woven fabric. The face of the towel has a pique effect and terry loop pile on the reverse. They are hemmed on four sides and measure 16 x 26 inches.

The applicable subheading for the 3-pack kitchen towel will be 6302.60.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for provides for bed linen, table linen, toilet linen and kitchen linen: toilet linen and kitchen linen, of terry toweling or similar terry fabrics, of cotton towels: dish. The duty rate will be 9.1 percent ad valorem.

The towels fall within textile category 369. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
