RE: The tariff classification of women’s sleepwear from China

Dear Ms. Beckford:

In your letter dated November 20, 2007, you requested a classification ruling on behalf of H & M Hennes & Mauritz LP. Your sample will be returned as requested.

Submitted sample, style #885800/1335, is a woman’s nightgown and matching thong-styled panty constructed from 100% polyester woven fabric. The pullover nightgown extends from the top of the bust to approximately the mid-thigh. The garment features adjustable, elasticized shoulder straps and a drawstring under the bust line. The thong-styled panty features an elasticized waist and leg openings. Both garments are embellished with contrasting colored trim.

The applicable subheading for the style 885800/1335 will be 6208.22.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ singlets and other undershirts, slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles: nightdresses and pajamas: of man-made fibers. The duty rate will be 16 percent ad valorem.

Style 885800/1335 falls within textile category 651.
