RE: The tariff classification of surf paddle bags and a blade bag

Dear Ms. Carchidi:

In your letter dated November 14, 2007 you requested a classification ruling. The samples which you submitted are being returned as requested.

Style number CASUP01 is identified as a full paddle bag. It is constructed with an outer surface of 100% polyester textile material. It is designed to store and protect a surf paddle when not in use. The bag has a single lined compartment with a zipper closure that extends down half the length of one side of the bag. It also has a webbed textile loop at the top and a textile carrying handle along the length of the bag. It measures approximately 7.4’ (L) and 12” (W).

Style number CASUP02 is identified as a full paddle bag. It is constructed with an outer surface of 100% polyester textile material. It is designed to store and protect a surf paddle when not in use. It has a flap with two lined interior compartments and secures with a hook and loop closure. The top of the bag has a webbed textile loop and a textile carrying handle along the length of the bag. It measures approximately 7.4’ (L) and 12” (W).

Style number CASUP04 is identified as a blade bag for a surf paddle. It is constructed with an outer surface of 100% polyester textile material. It is designed to store and protect the blade of a surf paddle when not in use. It has a zipper closure that extends down one side of the bag. The bag has a single lined compartment and a webbed textile loop at the top of the bag. It measures approximately 10” (W) x 20” (L).

The applicable subheading for the surf paddle bags and blade bag will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTSUS), which provides for trunks, suitcases...gun cases and similar containers, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.6 percent ad valorem.

HTSUS 4202.92.9026 falls within textile category 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
