RE: The tariff classification of chef pants from China.

Dear Ms. Dost:

In your letter dated November 9, 2007, on behalf of Chefwear, Inc., you requested a classification ruling. The samples which you submitted are being returned as requested.

Four samples of unisex chef pants were submitted with your request.

Style 3700 is made of woven 60% cotton/40% polyester fabric. The long pants have an elasticized waistband with drawstring two side pockets and two back patch pockets.

Styles 3000, 3200 and 3500 are made of woven 100% cotton fabric.

Style 3000 is a pair of long pants with an elasticized waistband with a drawstring two side pockets and two back patch pockets.

Style 3200 is a pair of long pants with an elasticized waistband with a drawstring and two back flap patch pockets and a cargo pockets with hook and loop closures and a side pocket on each side.

Style 3500 is a pair of stripped long pants with an elasticized waistband with a drawstring, two side pockets, and two patch pockets at the back.

  The applicable subheading for Styles 3700, 3000, 3200 and 3500 will be 6204.62.4021, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Women’s or girls’trousersTrousersOf cotton: Other: Other: Other, Trousers and breeches: Women’s: Other." The duty rate will be 16.6% ad valorem. The textile category designation is 348.
