RE: The tariff classification of Chef jackets from China.

Dear Mr. Dost:

In your letter dated November 5, 2007, on behalf of Chefwear, Inc., you requested a classification ruling. The samples will be returned to you as requested.

Five samples of unisex chef jackets were submitted with your request.

Styles 4400 and 4410 are made of woven 65% polyester/35% cotton fabric.

Style 4400 is a hip length, double breasted jacket with long sleeves, a mandarin collar, left breast and sleeve pocket, and a full front opening with knot closures that closes left over right or right over left. Style 4410 is identical to style 4400 with the exception that there are button closures.

Styles 5610, 5660 and 5650 are made of woven 60% cotton/40% polyester fabric.

Style 5610 is a hip length, double breasted jacket with short sleeves, a mandarin collar, left breast and sleeve pocket, and a full front opening with knot closures that closes left over right or right over left.

Style 5660 is a hip length pullover-style jacket with long sleeves and an adjustable snap mock turtle neck closure and a pocket on the left sleeve.

Style 5650 is a hip length jacket, double breasted jacket with long sleeves, a mandarin collar, left breast and sleeve pocket, and a full front opening with knot closures that closes left over right or right over left.

           The applicable subheading for Styles 4400 and 4410 will be 6206.40.3030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Women’s or girls’ blouses, shirts and shirt-blouses: Of man-made fibers: Other: Other, Other: Women’s." The duty rate will be 26.9% ad valorem. The textile category designation is 641.

The applicable subheading for Styles 5610, 5660, 5650 will be 6206.30.3041, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Women's or girls' blouses, shirts and shirt-blouses: Of cotton: Other: Other, Other: Women's. The duty rate will be 15.4% ad valorem. The textile category is 341.
