RE: The tariff classification of magnetic school frame (Item # 2330556) from China

Dear Ms. Freese:

In your letter dated November 12, 2007, you requested a tariff classification ruling.

The merchandise subject to this ruling is a magnetic school frame. It is identified within your letter as Item # 2330556. These magnetic photo frames consist of flexible magnetic material and measure approximately 4 ½” x 6 ½”. There is a cut-out in the middle of the flexible magnet to create a frame that a photograph can be placed behind. The writing on the insert of the magnetic photo frame states that it holds a 4” x 6” photograph. You’re your letter states that the principal use would be for hanging school pictures on refrigerators. A sample of the flexible magnetic photo frame was submitted to this office for classification purposes and is being returned to you as per your request.

In your request your question as to whether the magnetic photo frame is subject to anti-dumping. This merchandise is not subject to anti-dumping.

The applicable subheading for the magnetic school frame (Item # 2330556) will be 8505.19.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Permanent magnets and articles intended to become permanent magnets after magnetization. : Other: Flexible magnets.” The rate of duty will be 4.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
