RE: The tariff classification of men’s woven pants with shoulder straps from China.

Dear Ms. Moore:

In your letter dated November 14, 2007, you requested a tariff classification ruling on behalf of Alpine (USA) Sportswear Inc. As requested, your sample will be returned.

Style 123OVS is a pair of men’s pants constructed from 100% cotton, woven yarn dyed fabric. The garment falls below the knee and features a flat waistband with five belt loops; a button closure on the waistband; a fly front opening with a zipper closure; quarter pockets at each side; a coin pocket within the right quarter pocket; two rear patch pockets; one and one quarter inch wide shoulder straps that are buttoned at the front waistband and sewn to the rear waistband; and hemmed leg openings.

The applicable subheading for Style 123OVS will be 6203.42.4016, Harmonized Tariff Schedule of the United States (HTSUS), which provides for men’s or boys’trousers, bib and brace overalls, breeches and shorts: of cotton: other: other: trousers and breeches: men’s: other. The duty rate is 16.6% ad valorem.

Style 123OVS falls within textile category designation 347.
