RE: The tariff classification of printed circuit board assembly (SKU No. WSA2403) from China

Dear Ms. Hachmann:

In your letter dated November 8, 2007 you requested a tariff classification ruling. A sample was furnished for classification purposes and is being returned as per your request.

The merchandise subject to this ruling is a printed circuit board assembly. It is identified in your letter as SKU No. WSA2403. It provides starting and operating frequency power to an ultraviolet (UV) lamp in a water treatment system unit. It consists of a cylinder with four contacts (sockets) on the top, PCV sleeve, coil, switch, capacitors, inductor, and a micro module. The components are all mounted on a printed circuit board. As such, this is a printed circuit assembly.

When utilized, the UV bulb, which is attached to the UV lamp, plugs directly into the four contacts (sockets) on the top of the WSA2403 cylinder, at which time the coil receives power from the radio frequency transformers inside the encased electronic module and transmits it to the UV bulb, thus illuminating the UV lamp.

The applicable subheading for the printed circuit board assembly (SKU No. WSA2403) will be 8504.10.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Ballasts for discharge lamps or tubes.” The rate of duty will be 3.0 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
