RE: The tariff classification of a baby carriage part from Germany

Dear Ms. Dawson,

In your letter dated November 9, 2007, you requested a tariff classification ruling.

The item concerned is the Stroller Seat. In your Ruling Request you state the Seat cannot be used on its own and requires the use of a stroller frame which will be imported separately. The Stroller Seat is equipped with an adjustable foot rest, a folding canopy which encloses the front of the stroller, a clear plastic “window” for the child to look out of and a harness strap to secure the child inside the seat. It is constructed of aluminum, plastic, steel hardware and a covering of 100% polyester and measures approximately 1 foot 10 inches high, 2 feet in length and 15 inches wide.

The applicable classification subheading for the Stroller Seat will be 8715.00.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Baby carriages (including strollers) and parts thereof: Parts”. The rate of duty will be 4.4%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
