RE: The tariff classification of wine bags from China and Taiwan

Dear Mr. Halim:

In your letter dated November 8, 2007, you requested a tariff classification ruling on behalf of your client, Pacific Merchants Trading Co., Inc. of California.

You have submitted photos of wine bags in several designs that will be imported from China and Taiwan. You indicated in your letter that Item # 4226, “Gift Box Red” is made of plastic and the rest of the styles are made of paper. All styles have an open top and flat-bottom with coordinating double rope carry handles. The photos included a variety of abstract designs, wine bottle patterns and metallic paper bags. The metallic wine bags have a small gift card attached to the handles.

The applicable subheading for the wine bags will be 4819.40.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other (than certain enumerated) sacks and bags of paper. The rate of duty will be free.

Your inquiry does not provide enough information for us to give a classification ruling on Item #4226, “Gift Box Red” and Items #4222 through #4225, “Retro” colors. Your request for a classification ruling should include samples for our examination. When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.
