RE: The tariff classification of item number 67598, Dream Dazzlers Rock Star Dress Up Set Assortment from China

Dear Ms. Beck:

In your letter dated November 6, 2007, you requested a tariff classification ruling.

Item 67598, Dream Dazzlers Rock Star Dress Up Set Assortment, is an assortment of three flimsy costumes. “Cheetah” consists of a cheetah print top and pants, with the top imparting the essential character. “Pink” consists of a pink top and purple pants, with the top imparting the essential character. “Purple” is comprised of a purple and pink jumpsuit with sequin straps. Although each costume has a styling feature and/or well-made embellishments, the preponderance of each costume is flimsy, with loose overlock stitched seams, loose overlock stitched edges, a flimsy tab closure and flimsy thin elastics.

The applicable subheading for item number 67598, Dream Dazzlers Rock Star Dress Up Set Assortment will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
