RE: The tariff classification of a backpack from India

Dear Ms. Davidson:

In your letter dated November 1, 2007, you requested a classification ruling. The sample which you submitted is being retained by this office.

Item 10041816 is a backpack constructed with an outer surface of cotton textile material. It is designed to provide storage, protection, portability, and organization to clothing, sporting equipment, or other personal effects during travel. It has two permanently attached straps that allow the bag to be worn over the shoulders and on the back. It features a drawstring top closure, one large interior storage compartment, and an exterior pocket.

The applicable subheading for the backpack will be 4202.92.1500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sport, and similar bags, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction, of cotton. The duty rate will be 6.3%.

HTSUS 4202.92.1500 falls within textile category 369. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
