RE: The tariff classification of a men’s woven shirt from China.

Dear Ms. Mendoza:

In your letter dated October 30, 2007, you requested a tariff classification ruling. As requested, your sample is being returned.

Style R178986 is a men’s shirt, submitted in a size Medium, that is constructed from 100% linen, woven fabric. Style R178986 has a left-over-right, full front opening secured by five button closures; a spread collar; patch pockets on the chest; long vented sleeves with buttoned cuffs; two side entry pockets below the waist; and a straight, hemmed bottom.

The applicable subheading for Style R178986 will be 6205.90.4040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for men’s or boys’ shirts, of other textile materials: other: other: other: other. The duty rate is 2.8% ad valorem.

Style R178986 falls within textile category designation 840. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
