Dear Ms. Aldinger:

In your letter dated October 26, 2007, you requested a tariff classification ruling.

The samples submitted are as follows:

Item #80211 consists of a skytail, a ringwinder with string and a mini kite measuring approximately 10.16 cm x 0.33 cm. The kite has a picture of the cartoon character Tigger on a green background and the words “Disney My Friends Tigger & Pooh”.

Item #80212 consists of a skytail, a ringwinder with string and a mini kite measuring approximately 10.16 cm x 0.33 cm. The kite has a picture of the cartoon character Spider-Man on a blue background and words “The Amazing Spider-Man” and the name “Marvel”.

Item #80213 consists of a skytail, a ringwinder with string and a mini kite measuring approximately 10.16 cm x 0.33 cm. The kite has a picture of the cartoon character Thomas the Train on a blue background and words “Fast Moving”.

Item #80214 consists of a skytail, a ringwinder with string and a mini kite measuring approximately 10.16 cm x 0.33 cm. The kite has a picture of the cartoon character Tinkerbell and the words “Disney Fairies” on a green background.

Each of the above items is sold in a blister package.

The applicable subheading for the Tigger Kite Item# 80211, Spider-Man Kite Item# 80212, Thomas Kite Item # 80213, Faires Kite Item# 80214 (Mini Microlite Mylar Kite) will be 9503.00.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Tricycles, scooters, pedal cars other toys parts and accessories thereofOther. The rate of duty will be Free.
