RE: The tariff classification of a light box for an illuminated sign from China.

Dear Mr. Hoffacker:

In your letter dated October 22, 2007, you requested a tariff classification ruling on behalf of your client, Murray Feiss Import LLC.

The merchandise under consideration is a light box, Article Number POP8543. Photographs and a mechanical drawing of the light box were submitted with your ruling request. The light box is a rectangular box measuring approximately 100½ inches in length by 13½ inches by 13½ inches and constructed entirely of treated wood. One side of the entire length is open and designed to accept a translucent acrylic panel for displaying a brand name or other signage. The interior of the box features two four-foot florescent lamps mounted into sockets connected to ballasts with electrical wiring. It is stated in your ruling request that this box is solely an illuminated sign that is not used to display any products.

The applicable subheading for the light box, Article No. POP8543 will be 9405.60.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Lamps and lighting fittings includingilluminated signs, illuminated nameplates and the like, having a permanently fixed light source: Illuminated signs, illuminated nameplates and the like: Other.” The general rate of duty will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
