RE: The tariff classification of women’s sleep bottoms from Indonesia

Dear Ms. Irish:

In your letter dated October 23, 2007, you requested a classification ruling. Your samples will be returned as requested.

All of the submitted samples are women’s sleep bottoms constructed from 100% cotton woven fabric. Styles #82103008, 82103013 and 82103014 feature an elasticized waist, short legs with a decorative trim around the bottom, side vents and three non-functional buttons on the side.

You have indicated that these garments will be sold in the sleepwear department and are part of a mix and match sales concept. Based on their appearance and the manner in which they will be marketed, the garments are considered sleepwear.

The applicable subheading for all styles will be 6208.91.3010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ singlets and other undershirts, slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles: other: of cotton: other: women’s. The duty rate will be 11.2 percent ad valorem.

All styles fall within textile category 352. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
