RE: The tariff classification of a Waterproof Milking Set from China.

Dear Mr. Parsons:

In your letter dated October 19, 2007, you requested a classification ruling. The samples which you submitted are being returned as requested.

The submitted sample is a Waterproof Milking Set, identified as WMS. The Milking Set consists of an apron and two sleeve covers. The apron and sleeve covers are made of woven 100% nylon fabric coated on the inner surface with PVC plastic material. The bib-style apron covers the entire front torso and sides and extends to approximately mid-calf to ankle, with a textile neck strap and adjustable textile waist ties. The sleeve covers are a tube-like item and feature elastic and hook and loop closures at the top and bottom. The Waterproof Milking Set is used by Dairy Farmers when milking cows to protect their clothing from inadvertent splashing and when brushing up against wet and muddy cow under-bellies.

The apron imparts the essential character of the set.

 The applicable subheading for the Waterproof Milking Set (WMS), will be 6210.50.5055, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Garments, made up of fabrics of heading 5602, 5603, 5903, 5906 or 5907: Other women’s or girls’ garments: Of man-made fibers: Other, Other." The duty rate will be 7.1% ad valorem. The textile category designation is 659.
