RE: The tariff classification of a motor vehicle part from Japan

Dear Ms. Peach,

In your letter dated October 22, 2007, you requested a tariff classification ruling.

The item concerned is the Dynamic Damper (Part # 44351-S7A-003); it is a trapezoidal-shaped ring of steel with rubber molded over it’s entirety and measures approximately 2 ¾ inches in diameter at its widest, 1 ¼ inches in diameter at its narrowest X 2 inches in height. The Dynamic Damper serves as a weighting mechanism to dampen the effect of vibration on a vehicle driveshaft/drive-axle.

The applicable classification subheading for the Dynamic Damper (Part # 44351-S7A-003) will be 8708.99.5500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Parts of motor vehicles : Other parts : Other: Other: Other: Vibration control goods containing rubber”. The rate of duty will be 2.5%.
